At its March 22, 2024 meeting, the Texas Medical Board disciplined 22 licensed physicians. 

 

 The disciplinary actions included: two orders related to unprofessional conduct, six orders related to quality of care, four voluntary surrenders/revocations, one revocation, one restriction, two related to improper supervision or delegation, two related to Texas Physician Health Program violations, and four orders related to other states’ actions. The Board also ratified sixteen cease and desist orders.  

 

The Board issued 560 physician licenses at the March meeting, bringing the total number of physician licenses issued in Fiscal Year 2024 to 3,768.  

 

 

DISCIPLINARY ACTIONS  

 

UNPROFESSIONAL CONDUCT  

Garcia, Jan Jr., M.D., Lic. No. F8118, Webster  

On March 22, 2024, the Board and Jan Garcia, Jr., M.D., entered into an Agreed Order requiring him to within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete the professional boundaries course offered by Vanderbilt; and within one year complete at least eight hours in risk management. The Board found Dr. Garcia was unprofessional toward one medical professional in the operating room when he came up behind her and put his hands on her waist, and made inappropriate comments about her appearance.  

 

Ziworitin, Dama Alexander, M.D., Lic. No. P2178, Houston  

On March 22, 2024, the Board and Dama Alexander Ziworitin, M.D., entered into an Agreed Order publicly reprimanding Dr. Ziworitin and requiring him to have a chaperone present anytime he examines a female patient, either in person or utilizing telehealth/video-conferencing; within 30 days obtain an independent diagnostic evaluation from a psychiatrist and follow any recommendations for care and treatment; within six months complete the professional boundaries course offered by the University of California San Diego Physician Assessment and Clinical Education (PACE) program; and within one year complete at least eight hours of CME in ethics. The Board found Dr. Ziworitin engaged in a sexual relationship with a patient for which he was providing obstetrics and gynecological care which extended for multiple years.  

 

QUALITY OF CARE  

Ardeel, Eric, M.D., Lic. No. P3113, Conroe  

On March 22, 2024, the Board and Eric Ardeel, M.D., entered into an Agreed Order requiring him to within one year complete at least eight hours of CME, divided as follows: two hours in Center for Medicare and Medicaid Services (CMS) regulations regarding conditions of participation, four hours in medical recordkeeping and two hours in physicianpatient communications. The Board found Dr. Ardeel failed to communicate with the patient about the presence of an ovarian mass detected by CT scan when patient was being treated at the emergency department after a fall, failed to document the abnormal findings in the record, failed to refer the patient to a specialist for follow-up and evaluation and failed to ensure CMS discharge protocol requirements were met when the patient was discharged.  

 

Garza-Trevino, Enrique Sergio, M.D., Lic. No. E5375, Monterrey N.L., Mexico  

On March 22, 2024, the Board and Erique Sergio Garza-Trevino, M.D., entered into an Agreed Order requiring him to have his practice monitored by another physician for 12 consecutive monitoring cycles; within 90 days pay an administrative penalty of $2,000; and within one year complete at least 24 hours of CME, divided as follows: eight hours in prescribing controlled substances, eight hours in medical recordkeeping and eight hours in risk management. The Board found Dr. Garza-Trevino failed to meet the standard of care in his prescribing and treatment of one psychiatric patient even after the patient experienced adverse effects including mania and erratic behavior that led to hospitalization, and inappropriately prescribed to a second patient with whom he was involved personally and financially.  

 

Kevill, John W., M.D., Lic. No. R8766, The Woodlands  

On March 22, 2024, the Board and John W. Kevill, M.D., entered into an Agreed Order requiring him to within 30 days schedule an assessment with the Texas A&M Health Science Center Knowledge, Skills, Training, Assessment and Research (KSTAR) program; within one year complete at least 16 hours of CME, divided as follows: eight hours in medical recordkeeping, four hours in risk management, and four hours in patient communication. The Board found Dr. Kevill violated the standard of care for 11 patients by failing to properly follow up on patients for which he performed a neurological examination, failed to make proper referrals for additional treatment and failed to document the care provided to the patients. Dr. Kevill was subject of a peer review and terminated from employment as a result of his evaluation.  

 

Spann, Scott Weaver, M.D., Lic. No. K1685, Greenville, SC  

On March 22, 2024, the Board and Scott Weaver Spann, M.D., entered into an Agreed Order on Formal Filing requiring Dr. Spann to within one year complete at least 12 hours of CME, divided as follows: six hours in medical recordkeeping and six hours in risk management. The Board found Dr. Spann inadvertently misplaced a screw during a lumbar fusion procedure and did not adequately document his plan for addressing the patient’s leg pain. The order resolves a formal complaint filed at the State Office of Administrative Hearings.  

 

Spurlock, William Marcus, M.D., Lic. No. J7209, Richardson  

On March 22, 2024, the Board and William Marcus Spurlock, M.D., entered into an Agreed Order requiring him to within 60 days enroll in and successfully complete the PBI Medical Record Keeping course in joint partnership with the UCI School of Medicine; have his practice monitored by another physician for 12 consecutive monitoring cycles; and within 60 days pay an administrative penalty of $2,000. The Board found Dr. Spurlock did not properly evaluate and provide diagnostic testing for one telemedicine patient who presented with viral symptoms and was incorrectly diagnosed with a sinus infection.  

 

Story, Elizabeth Scott, M.D., Lic. No. S3934, Fort Worth  

On March 22, 2024, the Board and Elizabeth Scott Story, M.D., entered into an Agreed Order requiring her to within one year complete at least 16 hours of CME, divided as follows: eight hours in medical recordkeeping, four hours in risk management and four hours in appropriate treatment of detox patients. The Board found Dr. Story failed to provide appropriate care and treatment for one patient while supervising the patient’s alcohol detox from the patient’s home, failed to physically examine, evaluate, and provide follow-up care and maintain adequate medical records.  

 

VOLUNTARY SURRENDER/REVOCATION  

Busselberg, Lorin Fred, M.D., Lic. No. L7675, Houston  

On March 22, 2024, the Board and Lorin Fred Busselberg, M.D., entered into an Agreed Order of Voluntary Surrender in which he agreed to voluntarily surrender his Texas medical license in lieu of further disciplinary proceedings. Dr. Busselberg was under investigation for nontherapeutic prescribing to multiple patients and for operating an unregistered pain management clinic.  

 

Landers, Wilson H., M.D., Lic. No. F1728, Borger  

On March 22, 2024, the Board and Wilson H. Landers, M.D., entered into an Agreed Order of Voluntary Surrender in which he agreed to voluntarily surrender his Texas medical license in lieu of further disciplinary proceedings. Dr. Landers was under investigation for failing to comply with the Board’s continuing medical education audit.  

 

Pelly, Lorenzo R., M.D., Lic. No. G2453, Brownsville  

On March 22, 2024, the Board and Lorenzo R. Pelly, M.D., entered into an Agreed Order of Voluntary Surrender in which he agreed to voluntarily surrender his Texas medical license in lieu of further disciplinary proceedings. Dr. Pelly was under investigation for having his clinical privileges suspended for possible impairment. Dr. Pelly has indicated his desire to voluntarily surrender his license due to his age and wishes to cease practice of medicine.  

 

Seymour, Gregory Todd, M.D., Lic. No. K9663, Tomball  

On March 22, 2024, the Board and Gregory Todd Seymour, M.D., entered into an Agreed Order of Voluntary Surrender in which he agreed to voluntarily surrender his Texas medical license in lieu of further disciplinary proceedings. Dr. Seymour was under investigation for alleged violations of the standard of care treating one patient and non-compliance with a prior order.  

 

REVOCATION  

Ghanem, Fadi George, M.D., Lic. No. H8071, The Woodlands  

On March 22, 2024, the Board entered a Final Order, revoking Fadi George Ghanem, M.D.’s Texas medical license. Dr. Ghanem had been suspended after he was found guilty of a third-degree felony related to operating an unregistered pain management clinic. The action was based on the findings of an Administrative Law Judge at the State Office of Administrative Hearings (SOAH). The order resolves a formal complaint filed at SOAH.  

 

RESTRICTION  

Colvin, Jeffrey Norman, M.D., Lic. No. H2313, Lubbock  

On March 22, 2024, the Board and Jeffrey Norman Colvin, M.D., entered into an Agreed Order restricting his license and placing him under the following terms: shall not see, examine, treat, prescribe to, provide consultation for, or otherwise practice medicine on female patients; within 90 days pay an administrative penalty of $1,000 and shall not be permitted to supervise or delegate prescriptive authority to a physician assistant or advanced practice nurse or supervise a surgical assistant. The Board found that on November 18, 2023, Dr. Colvin was arrested on the charge of Indecent Assault, a Class A misdemeanor and was issuing prescriptions for Schedule II controlled substances with a listed fill date beyond 30 days.  

 

 

IMPROPER SUPERVISION OR DELEGATION  

Lewis, Jerry Wayne, M.D., Lic. No. H8208, Frisco  

On March 22, 2024, the Board and Jerry Wayne Lewis, M.D., entered into an Agreed Order publicly reprimanding Dr. Lewis and requiring him to within 10 days provide the Board documentation of all delegation orders and protocols; within one year complete at least 24 hours of CME, divided as follows: 12 hours in supervision/delegation, four hours in recordkeeping, four hours in risk management and four hours in ethics; within one year and three attempts pass the Medical Jurisprudence Exam; and within 60 days pay an administrative penalty of $5,000. The Board found Dr. Lewis improperly delegated patient examinations and follow up care to a registered nurse who was unqualified to provide this level of care at a med spa for which Dr. Lewis was the acting medical director. Dr. Lewis failed to provide any meaningful oversight of his delegates during the two-year time period at issue. 

 

Robert, Marshall Brooks, M.D., Lic. No. N5364, Fort Worth  

On March 22, 2024, the Board and Marshall Brooks Robert, M.D., entered into an Agreed Order requiring him to within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least 14 hours of CME, divided as follows: four hours in risk management, four hours in ethics and six hours in proper delegation and supervision. The Board found Dr. Robert, as medical director of Revive IV Hydration, failed to adequately supervise his delegate in the care and treatment of patients who were receiving IV treatments containing prescription medications.  

 

 

OTHER STATES’ ACTIONS  

Eilers, Steven Edwin, M.D., Lic. No. S2293, Lexington, KY  

On March 22, 2024, the Board and Steven Edwin Eilers, M.D., entered into a Waiver Order requiring him to comply with all terms of the agreement entered on or around October 17, 2023, with the State of Florida Department of Health. The Board found Mr. Eilers entered into an order with the Florida Board of Medicine for performing a wrong-site procedure. Specifically, Dr. Eilers performed a Mohs surgery on the wrong chest lesion for one patient.  

Epstein, Andrew Michael, D.O., Lic. No. T4740, San Antonio  

On March 22, 2024, the Board and Andrew Michael Epstein, D.O., entered into a Waiver Order requiring him to comply with all terms of the agreement entered on or around January 4, 2024, with the North Carolina Medical Board. The Board found Dr. Epstein was disciplined by the North Carolina Board for unprofessional conduct.  

 

Gill, Brijesh Singh, M.D., Lic. No. K9284, Houston  

On March 22, 2024, the Board and Brijesh Singh Gill, M.D., entered into a Waiver Order publicly referring Dr. Gill to the Texas Physician Health Program and requiring him to comply with the terms of the agreement entered on or around January 10, 2024 with the Colorado Medical Board. The Board found Dr. Gill had a disciplinary action taken against him by the Colorado Medical Board for unprofessional conduct related to a substance use disorder.  

 

Palumbo, Joseph Matthew, D.O., Lic. No. U2284, Highland Heights, OH  

On March 22, 2024, the Board and Joseph Matthew Palumbo, D.O., entered into a Waiver Order requiring him to comply with all terms of the agreement entered on or around November 15, 2023, with the Virginia Board of Medicine. The Board found Dr. Palumbo entered into an order with the Virginia Board of Medicine for aiding and abetting the unlicensed practice of medicine. Specifically, Dr. Palumbo authorized and allowed staff at IV vitamin infusion facilities to administer medications outside of his direction and supervision.  

 

 

TXPHP VIOLATION  

Reddy, Guduru Ramana, M.D., Lic. No. G2824, Weatherford  

On March 22, 2024, the Board and Guduru Ramana Reddy, M.D., entered into an Agreed Order publicly referring him to the Texas Physician Health Program. The Board found Dr. Reddy suffers from an impairment and was not in compliance with the monitoring agreement. Dr. Reddy has been participating in the program and has an agreement which includes a worksite monitor provision. Dr. Reddy has had difficulty obtaining a monitor due to solo practice and plans to join a group practice to obtain a worksite monitor going forward.  

 

Tolleson, Thaddeus, M.D., Lic. No. J6770, Tyler  

On March 22, 2024, the Board and Thaddeus Rex Tolleson, M.D., entered into an Agreed Order under the following terms for minimum of five years: shall limit his practice to a pre-approved group or institutional setting; within 30 days obtain a medical evaluation from an independent psychiatrist and follow all recommendations made for care and treatment; within 30 days obtain a board certified physician to serve as his work-site monitor; abstain from the consumption of prohibited substances as defined in the order; participate in the Board’s drug testing program; participate in the activities of Alcoholics Anonymous no less than one time a week; and participate in the activities of a county or state medical society committee on physician health and rehabilitation, including any weekly meetings. The Board found Dr. Tolleson failed to comply with the terms of his Texas Physician Health Program agreement having tested positive for drugs.  

 

 

CEASE & DESISTS  

Aghasyan, Mary Tereza, No License, Katy  

On March 22, 2024, the Board and Mary Tereza Aghasyan entered into an Agreed Cease and Desist Order prohibiting her from falsely acting as or holding herself out to be a licensed physician in the state of Texas, aiding or abetting any other individual acting as or holding themselves out to be a physician, or using an advertising statement that is false, misleading or deceptive. The Board found Ms. Aghasyan is the owner of “Milas’ Aesthetic Spa,” which advertised a number of non-surgical cosmetic procedures. Ms. Aghasyan does not have a physician or midlevel provider on staff, and no physician or midlevel is on-site during client encounters.  

 

Alvarez, Ana, No License, Spring  

On March 22, 2024, the Board and Ana Alvarez entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Alvarez is the sole proprietor of Europa Skincare Day Spa, and allows diagnosis and treatment, injections, with no physician examination, approval and standing orders, prior to injection administration, or proper supervision from a medical director.  

 

Armstrong, Nathanael, No License, Tomball  

On March 22, 2024, the Board and Nathanael Armstrong entered into an Agreed Cease and Desist Order prohibiting him from acting as, or holding himself out to be, a licensed physician in the state of Texas. The Board found Mr. Armstrong refers to himself as “Dr.” on his website and is engaging in the practice of medicine in Texas.  

 

Crone, Corey, No License, Austin  

On March 22, 2024, the Board and Corey Crone entered into an Agreed Cease and Desist Order prohibiting him from acting as, or holding himself out to be, a licensed physician in the state of Texas. The Board found Mr. Crone and his wife own a clinic which provided various cosmetic procedures without a physician or midlevel on-site.  

 

Crone, Yvemar “Eva”, No License, Austin  

On March 22, 2024, the Board and Yvemar “Eva” Crone entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Crone and her husband own a clinic which provided various cosmetic procedures without a physician or midlevel on-site.  

 

Lopez, Carissa, No License, Corpus Christi  

On March 22, 2024, the Board and Carissa Lopez entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Lopez owns and operates “Contoured Curves By Carissa,” which offers a variety of procedures including non-surgical cosmetic procedures including weight loss injections. Ms. Lopez does not have a physician director or midlevel practitioner involved in the practice.  

 

Low, Paulette, No License, Houston  

On March 22, 2024, the Board and Paulette Low entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Low applied for a psychiatry position with a staffing company and represented herself as a medical doctor licensed in Texas.  

 

Meekins, Jennifer, No License, Deer Park  

On March 22, 2024, the Board and Jennifer Meekins entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Meekins owns and operates a Deer Park practice that offers cosmetic and weight loss injections, which does not have a physician director or midlevel practitioner involved in the practice.  

 

Mejia, Katherine, No License, Houston  

On March 22, 2024, the Board and Katherine Mejia entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Mejia owned and operated a salon that offered facial injections.  

 

Miller, Korean, No License, Houston  

On March 22, 2024, the Board and Korean Miller entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Miller owns a business, Synergy Aesthetic, which advertises various procedures and holds no licenses or permits to provide the services, nor is she acting under the supervision of a physician or midlevel provider or delegation order.  

 

Morcom, David, Pharm. D., No License, Dallas  

On March 22, 2024, the Board and David Morcom entered into an Agreed Cease and Desist Order prohibiting him from acting as, or holding himself out to be, a licensed physician in the state of Texas. The Board found Mr. Morcom uses the title of “Dr.” in his advertising on Integrative Wellness’s website, although he states he is a Doctor of Pharmacology, he advertises and provides medical services.  

 

Shanshil, Shimaa, No License, Arlington  

On March 22, 2024, the Board and Shimaa Shanshil entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Shanshil is the sole proprietor of Shimaa Beauty Center and allows diagnosis and treatment, injections, with no physician examination, approval and standing orders, prior to injection administration, or proper supervision from a medical director for this company.  

 

Silva, Lenin Torres, No License, Houston  

On March 22, 2024, the Board and Lenin Torres Silva entered into an Agreed Cease and Desist Order prohibiting him from acting as, or holding himself out to be, a licensed physician in the state of Texas. The Board found Mr. Silva is advertising himself as a physician and offering to treat patients on his website, social media platforms, various magazine articles and his business cards.  

 

Stewart, Kerby James, No License, Liberty Hill  

On March 22, 2024, the Board and Kerby James Stewart entered into an Agreed Cease and Desist Order prohibiting him from acting as, or holding himself out to be, a licensed physician in the state of Texas. The Board found Mr. Stewart, whose Texas medical license was revoked on July 28, 2006, was employed by a residential treatment center as an executive director and was engaging in the practice of medicine without a license.  

 

Tovar, Maria, No License, Frisco  

On March 22, 2024, the Board and Maria Tovar entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Tovar, a dental hygienist, is offering teeth whitening, lip fillers and Botox at her residential address, and does not have a physician director or midlevel practitioner involved in the practice.  

 

Willard, Nathen, No License, Conroe  

On March 22, 2024, the Board and Nathen Willard entered into an Agreed Cease and Desist Order prohibiting him from acting as, or holding himself out to be, a licensed physician in the state of Texas. The Board found Mr. Willard on his website offered to treat health conditions with various products and supplements.
