Common Information Requests

House Bill 2038 (also known as the “DOCTOR Bill”) requires the Board to pass rules for implementation by January 1, 2026.  During rulemaking, the Board will establish the application process and documentation requirements. Once these items are determined, specific information will be available on the TMB website for those interested in applying. 

 

Although the Board strives to implement legislation as promptly as possible, the rulemaking process can take time. We recommend regularly checking the TMB website over the coming months for updates. Additionally, the Board often announces new programs through press releases and newsletters throughout the year. You are invited to join our email list to receive these communications.

Nonsurgical medical cosmetic procedures (including but not limited to the injection of medication or substances for cosmetic purposes, the administration of colonic irrigations, and the use of a prescription medical device for cosmetic purposes), have been determined by the TMB to be the practice of medicine.  Such medical acts can be properly delegated by a physician to individuals who have the appropriate training.  Please note, a physician, PA or APRN must either:

  1. be onsite during the procedure; or
  2. be immediately available for emergency consultation in the event of an adverse outcome; and
  3. if necessary, the physician must be able to conduct an emergency appointment with the patient.

There is currently no registration for Med Spa clinics in Texas.  The TMB registers pain management clinics, office-based anesthesia and clinics that are jointly owned by physicians and PAs.  Nonsurgical medical procedures performed in Texas, such as those offered at a Med Spa, are required to be delegated by a licensed physician, however there is no specific registration for this type of clinic at this time.

Under current Texas statute, elective IV hydration must be ordered by a physician, or a PA or APRN acting under adequate physician supervision.  The administration of the IV Hydration must be by a licensed professional nurse or higher-level licensee.  Texas Occupations code 172 provides for the delegation by a physician for the acts of prescribing, ordering, or administering elective intravenous therapy to certain medical professionals acting under adequate physician supervision.
