At its October 13, 2023 meeting, the Texas Medical Board disciplined 24 licensed physicians.
The disciplinary actions included: four orders related to unprofessional conduct, seven orders related to quality of care, one voluntary surrenders/revocation, three revocations, one order related to nontherapeutic prescribing, two orders related to violation of prior order, five orders related to other states’ actions, and one order related to the Texas Physician Health Program. The Board also ratified four cease and desist orders.
The Board issued 215 physician licenses at the October meeting, bringing the total number of physician licenses issued in Fiscal Year 2024 to 969.
DISCIPLINARY ACTIONS
UNPROFESSIONAL CONDUCT
Angulo Thompson, Daniella Del Pilar, M.D., Lic. No. S2219, Colleyville
On October 13, 2023, the Board and Daniella Del Pilar Angulo Thompson, M.D., entered into an Agreed Order prohibiting her from prescribing or dispensing controlled substances or dangerous drugs to herself or her immediate family or other persons with whom she has a close personal relationship; within 30 days obtain an independent chemical dependency/substance abuse evaluation; within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least eight hours of CME in ethics; and shall not supervise or delegate prescriptive authority to a physician assistant or advanced practice nurse or supervise a surgical assistant.
Kallal, Kevin John, M.D., Lic. No. H7766, Colleyville
On October 13, 2023, the Board and Kevin John Kallal, M.D., entered into an Agreed Order under the following terms: publicly referred to the Texas Physician Health Program; for all patient encounters, either in person or utilizing telehealth/videoconferencing services, shall have a chaperone present; within one year and three attempts pass the Medical Jurisprudence Exam; and within one year complete at least 16 hours of CME, divided as follows: four hours in ethics, four hours in risk management, four hours in prescribing controlled substances and four hours in medical recordkeeping. The Board found Dr. Kallal made inappropriate sexual conduct and comments and boundary violations with patients and staff. Dr. Kallal failed to adequately prescribe for six patients, and at all times relevant, suffered from impairment due to a mental or physical condition.
Moss, Sue, M.D., Lic. No. H0662, Georgetown
On October 13, 2023, the Board and Sue Moss, M.D., entered into an Agreed Order requiring her to within 60 days complete all requirements of the Remedial Plan entered on March 5, 2021. Dr. Moss must complete the required CME and payment of all administrative fees; within one year and three attempts pass the Medical Jurisprudence Exam; and within one year complete at least 8 additional hours of CME in ethics. The Board found Dr. Moss is in violation of her Remedial Plan by not completing the required CME within one year or paying the administrative fees and Dr. Moss has been uncooperative with Board staff.
Pham, Dung Quoc, M.D., Lic. No. N3993, Houston
On October 13, 2023, the Board and Dung Quoc Pham, M.D., entered into a Mediated Agreed Order requiring him to within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least eight hours of CME, divided as follows: four hours in risk management and four hours in ethics; and within 60 days pay an administrative penalty of $2,000. The Board found Dr. Pham admitted that he may have violated a patient’s confidentiality after posting details of the patient’s care on social media without the patient’s signed consent in the medical chart. Dr. Pham resigned after initiation of an investigation, though it was not proved he was aware of the pending investigation. Although there was a patient Dr. Pham had previously provided appropriate urological care for and who may have still needed care, Dr. Pham resigned from the call coverage contract and his privileges at St. Joseph Medical Center in Houston, Texas. The order resolves a formal complaint filed at the State Office of Administrative Hearings.
QUALITY OF CARE
Blair, Donald Levester, Jr., M.D., Lic. No. H4171, DeSoto
On October 13, 2023, the Board and Donald Levester Blair, Jr., M.D., entered into an Agreed Order under the following terms: will not engage in or supervise delegates in the practice of obstetrics (does not apply to Gynecology) until he provides notice to the Board at least 30 days prior. If returning to obstetrics, Dr. Blair shall have his obstetrics practice monitored by another physician for eight consecutive monitoring cycles. Additionally, Dr. Blair is required to within one year complete the medical recordkeeping course offered by the University of California San Diego Physician Assessment and Clinical Education (PACE) program; and within one year complete at least eight hours of CME in high-risk obstetrics. The Board found Dr. Blair failed to meet the standard of care for Patient 1 by failing to respond to the patient’s emergent status involving a hemorrhagic pregnancy loss. For Patient 2, Dr. Blair inadequately communicated with hospital staff by failing to respond appropriately to requests from the patient and nursing staff to examine the patient for possibility of an expanding hematoma. Ultimately the patient did not have an expanding hematoma or other emergency condition. Dr. Blair failed to keep adequate medical records for six patients, including Patients 1 and 2, and voluntarily ceased practicing obstetrics.
Dyslin, David Cole, M.D., Lic. No. J9667, Fort Worth On October 13, 2023, the Board and David Cole Dyslin, M.D., entered into an Agreed Order requiring him to within one year complete at least 16 hours of CME, divided as follows: eight hours in recordkeeping and eight hours in physicianpatient communication; and within 60 days pay an administrative penalty of $3,000. The Board found Dr. Dyslin failed to adequately disclose possible side effects of, and alternatives to, a bariatric surgery to the patient prior to the surgery and failed to keep adequate medical records.
Friedman, Justin, M.D., Lic. No. R7996, Dallas
On October 13, 2023, the Board and Justin Friedman, M.D., entered into an Agreed Order requiring him to within one year complete at least eight hours of CME in management of intraoperative and perioperative complications during orthopedic surgery. The Board found Dr. Friedman violated the standard of care for the treatment of two patients and should have aborted the procedures. The first patient went into cardiac arrest during surgery and Dr. Friedman disregarded the anesthesiologist’s concerns and attempts to resuscitate the patient, and for a second patient, Dr. Friedman continued to perform a right hip arthroplasty and ordered a wound vac and placement of the device after the patient coded and resuscitation was being performed.
Grebennikov, Vladimir A., M.D., Lic. No. K9291, Richardson
On October 13, 2023, the Board and Vladimir A. Grebennikov, M.D., entered into an Agreed Order requiring him to have his practice monitored by another physician for four consecutive monitoring cycles; within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least 16 hours of CME, divided as follows: four hours in ethics, four hours in risk management, four hours in medical recordkeeping and four hours in informed consent; and within 60 days pay an administrative penalty of $2,500. The Board found Dr. Grebennikov failed to meet the standard of care and committed unprofessional conduct when a female visited his office to speak about business related issues. Dr. Grebennikov allegedly forced her into an exam room and injected her face with an unknown substance without her consent. Dr. Grebennikov has no medical records that show the procedure notes or any signed informed consent for the procedure, nor did he establish a physician-patient relationship or evaluate her prior to performing the procedure.
Le, Duc Minh, M.D., Lic. No. M8117, Cleveland
On October 13, 2023, the Board and Duc Minh Le, M.D., entered into an Agreed Order under the following terms: restricted from advertising stem cell therapies or providing stem cell therapies in a non-IRB approved setting; have his practice monitored by another physician for eight consecutive monitoring cycles; within one year and three attempts pass the Medical Jurisprudence Exam; within 90 days pay an administrative penalty of $5,000; and within one year complete at least 32 hours of CME, divided as follows: eight hours in ethics, eight hours in medical recordkeeping, eight hours in risk management and eight hours in complementary and alternative medicine. The Board found Dr. Le failed to document a thorough history and physical examination before treating one patient with trigger point stem cell injections, failed to document informed consent for the injection of the stem cells and advertised unfounded claims about the benefits of treatment without disclosure that the treatment is not FDA approved for back pain.
Redfield, James Earl, Jr. M.D., Lic. No. H2713, Nacogdoches
On October 13, 2023, the Board and James Earl Redfield, Jr., M.D., entered into an Agreed Order under the following terms: shall not diagnose, treat or examine any patient in Texas, nor use his Texas license to practice medicine, including telemedicine; Dr. Redfield’s license is suspended until he requests in writing and appears before the Board to provide evidence that he is physically, mentally, and otherwise competent to safely practice medicine. Such evidence shall include, at minimum, completion of KSTAR assessment and adherence to all recommendations. Within 30 days Dr. Redfield shall schedule an assessment with the Texas A&M Health Science Center Knowledge, Skills, Training, Assessment, and Research (KSTAR) program; and shall not be permitted to supervise or delegate prescriptive authority to physician assistants or advanced practice nurses or supervise surgical assistants. The Board found Dr. Redfield failed to meet the standard of care when the patient was not properly prepped prior to going into surgery. Dr. Redfield failed to recognize he perforated the patient’s bowel during the initial surgery and failed to timely perform appropriate postoperative interventions.
Wang, Fan, M.D., Lic. No. M2236, Houston
On October 13, 2023, the Board and Fan Wang, M.D., entered into a Mediated Agreed Order publicly reprimanding Dr. Wang and requiring him to within one year complete at least 28 hours of CME, divided as follows: 24 hours in high-risk obstetrics and four hours in documentation and medical records. The Board found Dr. Wang violated the standard of care for the three patients involved by failing to maintain adequate medical records; as well as failure to manage risk factors related to preeclampsia and cardiac disease in pregnancy. Dr. Wang was subjected to peer review disciplinary action related to his treatment and care of the three patients and voluntarily resigned his privileges. The order resolves a formal complaint filed at the State Office of Administrative Hearings.
VOLUNTARY SURRENDER/REVOCATION
Kaesler, Kelly, M.D., Lic. No. D5760, Houston
On October 13, 2023, the Board and Kelly Kaesler, M.D., entered into an Agreed Order of Voluntary Surrender in which he agreed to voluntarily surrender his Texas medical license in lieu of further disciplinary proceedings. The Board alleged that Dr. Kaesler is unable to safely practice medicine due to an impairment and that he terminated his practice without proper notification to one patient.
REVOCATION
Coppedge, Woodrow William, M.D., Lic. No. L2853, Richmond
On October 13, 2023, the Board entered a Default Order regarding Woodrow William Coppedge, M.D., which revoked his medical license. On June 3, 2023, the Board filed a Complaint with the State Office of Administrative Hearings (SOAH), alleging unprofessional conduct and impairment. Dr. Coppedge failed to appear at the SOAH hearing and no responsive pleading was ever filed by Dr. Coppedge. The Board granted a Determination of Default and Dr. Coppedge’s license was revoked by Default Order. The order resolves a formal complaint filed at SOAH. Dr. Coppedge has 25 days from the service of the order to file a motion for rehearing.
Martinez, Jordan Michael, M.D., Lic. No. BP10075345, Arlington
On October 13, 2023, the Board entered a Default Order regarding Jordan Michael Martinez, M.D., which revoked his physician-in-training permit. On June 29, 2023, the Board filed a Complaint with the State Office of Administrative Hearings (SOAH), alleging impairment. Dr. Martinez failed to appear at the SOAH hearing and no responsive pleading was ever filed by Dr. Martinez. The Board granted a Determination of Default and Dr. Martinez’s permit was revoked by Default Order. The order resolves a formal complaint filed at SOAH. Dr. Martinez has 25 days from the service of the order to file a motion for rehearing.
Nix, Darryl Dean, D.O., Lic. No. F9883, Dallas
On October 13, 2023, the Board entered a Default Order regarding Darryl Dean Nix, D.O., which revoked his medical license. On August 3, 2023, the Board filed a Complaint with the State Office of Administrative Hearings (SOAH), alleging failure to meet the standard of care and unprofessional conduct. On October 13, 2023, the Board and Zeeshan Mohammad Khan, M.D., entered into an Agreed Order requiring him to have his practice monitored by another physician for 12 consecutive monitoring cycles; and within one year complete at least 24 hours of CME, divided as follows: 12 hours in prescribing controlled substances, eight hours in medical recordkeeping and four hours in risk management. The Board found Dr. Khan failed to meet the standard of care, keep adequate medical records, check the Prescription Monitoring Program, and failed to have controlled substances agreements regarding three patients.
VIOLATION OF PRIOR ORDER
Eidman, Dan Kelly, M.D., Lic. No. E4316, Houston
On October 13, 2023, the Board and Dan Kelly Eidman, M.D., entered into an Agreed Modification Order which modified Dr. Kelly’s June 2020 Order. The modification adds two additional consecutive chart monitoring cycles. The Board found Dr. Kelly failed to implement his chart monitor's recommendations. All other terms of the order remain in full effect.
Lopez, Jesus Antonio, M.D., Lic. No. L1649, San Antonio On October 13, 2023, the Board and Jesus Antonio Lopez, M.D., entered into an Agreed Order requiring him to within 90 days complete the CME required by the December 2021 Order; and within 90 days pay an administrative penalty of $1,000. The Board found Dr. Lopez failed to complete the Medical Jurisprudence Exam within one year and failed to complete the required eight hours of CME on billing within the one-year deadline as required by his 2021 Order.
OTHER STATES’ ACTIONS
Hall, Gregory, M.D., Lic. No. S7883, Houston
On October 13, 2023, the Board and Gregory Hall, M.D., entered into a Waiver Order publicly reprimanding him and requiring him to comply with all terms of the Final Decision Order entered on or around June 21, 2023 with the Wisconsin Medical Examining Board. The Board found Dr. Hall was disciplined by the Wisconsin Board based on his failure to identify a Lisfranc injury, which delayed patient care.
Jaindl, Jeffrey, D.O., Lic. No. P2464, Eden Prairie, MN
On October 13, 2023, the Board and Jeffrey Jaindl, D.O., entered into a Waiver Order publicly reprimanding him. The Board found Dr. Jaindl entered into a Consent Order with the Virginia Board of Medicine based on a failure to recognize an epidural abscess on a patient; which compressed the patient’s spine, delayed patient care, and ultimately rendered the patient quadriplegic.
Purdy, Laura, M.D., Lic. No. S8483, San Francisco, CA
On October 13, 2023, the Board and Laura Purdy, M.D., entered into a Waiver Order requiring her to comply with all terms of the Corrected Determination and Order entered on or around May 18, 2023 with the Mississippi Board of Medical Licensure. The Board found Dr. Purdy entered into the order with the Mississippi Board based on improper prescribing to patients without establishing a valid physician-patient relationship.
Ray, Daniel Butler, M.D., Lic. No. Q6268, Grand Prairie
On October 13, 2023, the Board and Daniel Butler Ray, M.D., entered into a Waiver Order publicly reprimanding him and requiring him to comply with all terms of the Consent Agreement entered on or around April 3, 2023 with the State Medical Board of Ohio. The Board found Dr. Ray entered into a Consent Agreement with the Ohio Board based on prescribing to a patient without appropriate prescription monitoring and medical recordkeeping.
Zahoor, Talal, M.D., Lic. No. S8266, Houston
On October 13, 2023, the Board and Talal Zahoor, M.D., entered into an Agreed Order prohibiting him from diagnosing, treating or prescribing for patients in Texas or using his Texas license to practice in any jurisdiction until he requests in writing and appears before the Board to provide evidence that he is physically, mentally, and otherwise competent to safely practice medicine; and shall comply with all terms of the requirements entered on or around June 23, 2022 with the Oklahoma State Board of Licensure. The Board found Dr. Zahoor entered into an order with the Oklahoma Board stating he engaged in pill mill activity, improper prescribing for family members, standard of care violations and improper prescribing to himself.

Silva, Sergio, M.D., Lic. No. J8773, Houston
On October 13, 2023, the Board and Sergio Silva, M.D., entered into an Agreed Order requiring him to within 30 days obtain a board certified psychiatrist and psychologist and follow recommended care and treatment; abstain from the consumption of prohibited substances as defined in the order; participate in the Board’s drug testing program; participate in the activities of Alcoholics Anonymous no less than three times a week; and participate in the activities of Caduceus no less than three times a month. The Board found Dr. Silva has been non-compliant with the terms of his agreement with the Texas Physician Health Program.
CEASE & DESISTS
Brea, Helena, No License, Frisco
On October 13, 2023, the Board and Helena Brea entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Brea asserted that she is certified as a “Medical Aesthetics Physician, M.A.P.” and ordered lab tests and treated multiple patients.
Dimas, Christine, No License, San Antonio
On October 13, 2023, the Board and Christine Dimas entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Dimas treated two patients for injection fillers without she and the medical director meeting rule requirements as detailed in Rule 193.17.
Forsberg, Dianna M., No License, Dallas
On October 13, 2023, the Board and Dianna M. Forsberg entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Forsberg, on her med spa website, identified herself as “Dr.” where she is also pictured wearing scrubs with “Dr.” followed by her name embroidered on her top. Ms. Forsberg’s website does not include any health professional, such as a physician, physician assistant or nurse practitioner.
Higgins, Evelyn, No License, Jupiter, FL
On October 13, 2023, the Board and Evelyn Higgins entered into an Agreed Cease and Desist Order prohibiting her from acting as, or holding herself out to be, a licensed physician in the state of Texas. The Board found Ms. Higgins used the title doctor without showing any authority to use the title and engaged in the unlicensed practice of medicine by treating one patient for a mental/physical illness.
