At its June 9, 2023 meeting, the Texas Medical Board disciplined 47 licensed physicians. 

 

The disciplinary actions included: eleven orders related to unprofessional conduct, nine orders related to quality of care, six voluntary surrenders/revocations, three revocations, three orders related to nontherapeutic prescribing, two orders related to improper supervision or delegation, one order related to violation of Board rules, ten orders related to other states’ actions, and two orders related to inadequate medical records. The Board also ratified two cease and desist orders.  

 

The Board issued 310 physician licenses at the June meeting, bringing the total number of physician licenses issued in Fiscal Year 2023 to 5,313. 

 

 

DISCIPLINARY ACTIONS 

 

UNPROFESSIONAL CONDUCT  

Alalwan, Ali Abdulrazzaq A., Lic. No. BP10071652, Amarillo  

On June 9, 2023, the Board and Ali Abdulrazzaq A. Alalwan, M.D., entered into an Agreed Order publicly reprimanding Dr. Alalwan and requiring him to within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least 12 hours of CME, divided as follows: four hours in ethics, four hours in prescribing and four hours in risk management; and within 60 days pay an administrative penalty of $1,000. The Board found Dr. Alalwan attempted to pay apartment cleaning fees by providing prescription medication without having evaluated the person nor establishing a physician-patient relationship.  

 

Baker, Ronald Fredrick, M.D., Lic. No. L5234, El Paso  

On June 9, 2023, the Board and Ronald Fredrick Baker, M.D., entered into an Agreed Order requiring him to within one year complete at least 20 hours of CME, divided as follows: eight hours in risk management and 12 hours in ethics; and within 60 days pay an administrative fee of $4,000. The Board found Dr. Baker inappropriately prescribed to one patient with whom he did not have a valid physician-patient relationship and prescribed high-cost vitamins and common medications by electronic communications for over 1,100 patients screened and referred by a telemedicine company.  

 

Bishai, Emad Mikhail Tewfik, M.D., Lic. No. N7224, Conroe On June 9, 2023, the Board and Emad Mikhail Tewfik Bishai, M.D., entered into an Agreed Order suspending Dr. Bishai’s medical license; however, the suspension is stayed and he is placed on probation under the following terms: shall not use his Texas license in any jurisdiction to diagnose, treat, or prescribe controlled substances to patients in Texas for chronic or post-surgical, post-procedure, persistent non-chronic pain as defined by Board rules or engage in the practice of pain management in Texas; limit his practice to psychiatry and family medicine; have his practice monitored by another physician for eight consecutive monitoring cycles; and shall not be permitted to supervise or delegate prescriptive authority to a physician assistant or advanced practice nurse or supervise a surgical assistant. The Board found Dr. Bishai entered into a settlement agreement with the U.S. Department of Justice excluding him from participating in any federal health care programs based on allegations that he submitted false claims for the placement of electro-acupuncture devices and for making false statements when applying for a loan from the Paycheck Protection Program. The order does not supersede any prior orders.  

 

De Jesus, Alex, M.D., Lic. No. H5866, Houston  

On June 9, 2023, the Board and Alex De Jesus, M.D., entered into an Agreed Order publicly reprimanding Dr. De Jesus and requiring him to within 30 days comply with Board rule requirements for termination of practice; within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least 16 hours of CME, divided as follows: eight hours in ethics and eight hours in risk management; and within 60 days pay an administrative penalty of $2,000. The Board found that Dr. De Jesus terminated his practice without providing reasonable notice and opportunity for at least one patient to obtain their medical records. Dr. De Jesus also failed to timely respond to Board subpoenas.  

 

Escandon, Jose Ambrosio, M.D., Lic. No. P1994, Mission  

On June 9, 2023, the Board and Jose Ambrosio Escandon, M.D., entered into an Agreed Order requiring him to within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least 16 hours of CME, divided as follows: eight hours in risk management and eight hours in ethics; and within 60 days pay an administrative penalty of $1,000. The Board found Dr. Escandon ordered and billed for ultrasound treatments that were deemed medically unnecessary or unreasonable for ten patients. Dr. Escandon entered into a settlement agreement with the U.S. Department of Justice for violations of the False Claims Act 31 USC Sections 3729-3733 requiring him to pay a fine and subjecting him to random audits of his Medicare, Tricare and Medicaid claims for three years.  

 

Geralde, Renato A., D.O., Lic. No. M0728, San Antonio  

On June 9, 2023, the Board and Renato A. Geralde, D.O., entered into a Mediated Agreed Order requiring him to within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least 16 hours of CME, divided as follows: eight hours in risk management, four hours in boundaries and four hours in ethics; and within 60 days pay an administrative penalty of $3,000. The Board found Dr. Geralde admitted he brought a pepper spray pistol to his workplace, engaged in reciprocal horseplay in the workplace, resigned from his position and was later terminated. The order resolves a formal complaint filed at the State Office of Administrative Hearings.  

 

Haygood, Kenneth D., M.D., Lic. No. K2341, Tyler  

On June 9, 2023, the Board entered a Final Order regarding Kenneth D. Haygood, M.D., publicly reprimanding Dr. Haygood; prohibiting him from seeing, examining, treating, prescribing to, providing consultation for, or otherwise practicing medicine on female patients, including telemedicine; within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete the professional boundaries course offered by the University of California San Diego Physician Assessment and Clinical Education (PACE) program; within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least 24 hours of CME, divided as follows: eight hours in ethics, eight hours in communication skills and eight hours in HIPAA; and within 60 days pay an administrative penalty of $5,000. The Board found Dr. Haygood failed to meet the standard of care and did not obtain consent prior to performing a physical exam of a female patient, inappropriately discussed the encounter with the patient’s mother and her husband via text message disclosing her confidential medical information and Protected Health Information, and in an attempt to intimidate them as witnesses. The order resolves a formal complaint filed at the State Office of Administrative Hearings.  

 

Khalil, Mohammad Arshad, M.D., Lic. No. K7566, Sherman  

On June 9, 2023, the Board and Mohammad Arshad Khalil, M.D., entered into an Agreed Order requiring him to within one year complete at least 16 hours of CME, divided as follows: eight hours in risk management and eight hours in professionalism/ethics. The Board found Dr. Khalil acted unprofessionally when he allowed his medical staff privileges to expire while under investigation and under a Focused Professional Performance Evaluation.  

 

Ochoa, Alexander Michael, M.D., Lic. No. S1200, Live Oak  

On June 9, 2023, the Board and Alexander Michael Ochoa, M.D., entered into an Agreed Order publicly reprimanding Dr. Ochoa; prohibiting him from diagnosing, treating, or examining any patient in Texas or using his Texas license to practice medicine, including telemedicine, until he requests in writing and appears before the Board to provide evidence that he is physically, mentally, and otherwise competent to safely practice medicine. The Board found Dr. Ochoa inappropriately prescribed dangerous drugs and controlled substances to three patients with whom he had a close personal relationship, failed to keep medical records documenting the care, issued prescriptions for a patient using the prescription pad of another physician, and failed to respond to Board staff requests for information. The order resolves a formal complaint filed at the State Office of Administrative Hearings.  

 

Riyaz, Farhaad Rahman, M.D., Lic. No. S8106, Manassas, VA  

On June 9, 2023, the Board and Farhaad Rahman Riyaz, M.D., entered into an Agreed Order publicly reprimanding Dr. Riyaz and revoking his license; however, the revocation is stayed and he is placed on probation under the following terms: publicly referred to the Texas Physician Health Program; within 30 days obtain a pre-approved board certified psychiatrist and follow all recommendations made for care and treatment; and comply with all terms and requirements of the Judgement of the U.S. District Court for the Eastern District of Virginia entered on March 22, 2022. The Board found Dr. Riyaz pled guilty to mail fraud in Federal Court in Virginia.  

 

Slater, Patrick W., II, M.D., Lic. No. K5006, Austin  

On June 9, 2023, the Board and Patrick W. Slater, II, M.D., entered into an Agreed Order lifting the temporary suspension and publicly referring him to the Texas Physician Health Program (TXPHP). The Board found Dr. Slater, who was temporarily suspended due to impairment issues, has entered into a five-year monitoring agreement with TXPHP and underwent extensive evaluation at the Talbott Recovery Center.  

 

 

QUALITY OF CARE  

Anderson, Charles Peter, M.D., Lic. No. E1801, Kyle  

On June 9, 2023, the Board and Charles Peter Anderson, M.D., entered into an Agreed Order requiring him to within 30 days contact the Texas A&M Health Science Center Knowledge, Skills, Training, Assessment, and Research (KSTAR) program to schedule an assessment; within six months complete the medical recordkeeping and prescribing courses, particularly in regards to opioid prescribing, offered by the University of California San Diego Physician Assessment and Clinical Education (PACE) program; and within 60 days pay an administrative penalty of $500. The Board found Dr. Anderson prescribed large amounts of controlled substances to a patient without appropriate indications or monitoring resulting in drug misuse and diversion.  

 

Bosquez, Lourdes Ramirez, M.D., Lic. No. K2422, The Woodlands  

On June 9, 2023, the Board and Lourdes Ramirez Bosquez, M.D., entered into an Agreed Order requiring him to have his practice monitored by another physician for four consecutive monitoring cycles; within one year complete at least 24 hours of CME, divided as follows: eight hours of treating psychiatric patients who have chronic pain/comorbidities, eight hours in medical recordkeeping, four hours in prescribing controlled substances and four hours in recognizing drug seeking behavior; and within 60 days pay an administrative penalty of $2,000. The Board found Dr. Bosquez failed to meet the standard of care and adequately prescribe opioids for one patient in the management of the patient’s reported pain from fibromyalgia.  

 

Cazzaniga, Stefano, M.D., Lic. No. Q5363, Arlington  

On June 9, 2023, the Board and Stefano Cazzaniga, M.D., entered into an Agreed Order requiring him to within one year complete at least 16 hours of CME, divided as follows: eight hours in medical recordkeeping and eight hours in risk management. The Board found Dr. Cazzaniga ordered cardiology tests but didn’t follow through to see that the tests got worked up and he could have documented the details of his conversation with the patient much better.  

 

Fulp, Ray R. Trey, III, D.O., Lic. No. J7963, McAllen  

On June 9, 2023, the Board and Ray R. Trey Fulp, III, D.O., entered into an Agreed Order requiring him to within 30 days contact the Texas A&M Health Science Center Knowledge, Skills, Training, Assessment, and Research (KSTAR) program to schedule an assessment; and within 90 days pay an administrative penalty of $3,000. The Board found Dr. Fulp performed a mistaken discectomy on one patient.  

 

Jones, George Franklin, M.D., Lic. No. F6801, Plano  

On June 9, 2023, the Board and George Franklin Jones, M.D., entered into an Agreed Order requiring him to within 30 days contact the Texas A&M Health Science Center Knowledge, Skills, Training, Assessment, and Research (KSTAR) program to schedule an assessment; and within 30 days obtain an independent medical evaluation from a board certified psychiatrist approved in advance. The Board found Dr. Jones violated the standard of care for one patient by not timely initiating administration of anesthesia during a surgical procedure. Dr. Jones resigned his privileges while under peer review investigation when he saw the direction of the peer process and investigation.  

 

Miller, Melissa Battiest, M.D., Lic. No. M3467, Cedar Park  

On June 9, 2023, the Board and Melissa Battiest Miller, M.D., entered into an Agreed Order requiring her to within one year complete the TMB Remedial Coaching Program at the University of Texas at Dallas School of Management; within one year complete at least 16 hours of CME, divided as follows: eight hours in treating chronic pain and eight hours in detecting signs of controlled substance abuse/diversion; and within 60 days pay an administrative penalty of $3,000. The Board found Dr. Miller prescribed pain medications to one chronic pain patient despite red flags of the patient requesting refills early and pharmacy shopping. Dr. Miller’s medical records for the patient were insufficient and she did not properly modify the patient’s treatment regimen.  

 

Ng, Federico Roman, M.D., Lic. No. J6623, San Antonio On June 9, 2023, the Board and Federico Roman Ng, M.D., entered into an Agreed Order Upon Formal Filing publicly reprimanding Dr. Ng; requiring him to within one year and three attempts pass the Medical Jurisprudence Exam; and within one year complete at least eight hours of CME in treating chronic gastrointestinal conditions. The Board found Dr. Ng failed to thoroughly evaluate a patient before diagnosis, and did not review the patient’s prior medical records or document what other medications the patient was previously taking. The order resolves a formal complaint filed at the State Office of Administrative Hearings.  

 

Randolph, Beryl Lynn, M.D., Lic. No. N4026, Houston  

On June 9, 2023, the Board and Beryl Lynn Randolph, M.D., entered into an Agreed Order requiring her to before returning to surgical practice, have a pre-approved surgeon who specializes in obstetrics and gynecology to proctor her next 25 non-emergent procedures; prior to returning to surgical practice, complete at least 28 hours of CME, divided as follows: eight hours in appropriate patient selection for high surgical risk patients, eight hours in risk management, eight hours in recognizing intraoperative complications and four hours in treating endometrial hyperplasia. The Board found Dr. Randolph failed to meet the standard of care for one patient. Specifically, Dr. Randolph improperly advised the patient to choose a hysterectomy over hormonal therapy for endometrial hyperplasia, improperly performed the hysterectomy resulting in complications and was the subject of peer review action based on the case.  

 

Theesfeld, Daniel Robert, M.D., Lic. No. J3712, Longview  

On June 9, 2023, the Board and Daniel Robert Theesfeld, M.D., entered into an Agreed Order requiring him to within one year complete the prescribing course offered by the University of California San Diego Physician Assessment and Clinical Education (PACE) program. The Board found Dr. Theesfeld failed to appropriately monitor a patient and failed to timely address urine drug screens that showed the patient was drinking alcohol and tested positive for illegal drugs, taking controlled substances that were not prescribed, and negative for controlled substances that Dr. Theesfeld did prescribe.  

 

 

VOLUNTARY SURRENDER/REVOCATION  

Adams, Jerome Mark, M.D., Lic. No. C5941, Wichita Falls  

On June 9, 2023, the Board and Jerome Mark Adams, M.D., entered into an Agreed Order of Voluntary Surrender in which he agreed to voluntarily surrender his Texas medical license in lieu of further disciplinary proceedings. The Board found Dr. Adams reported that he has retired from medical practice. On June 17, 2021, when submitting his license for renewal Dr. Adams reported that he had surrendered his DEA controlled substances certificate for cause related to his failure to comply with federal requirements for prescribing controlled substances. Additionally, Dr. Adams did not release a patient’s medical records upon request. The order resolves a formal complaint filed at the State Office of Administrative Hearings. 

 

Buckner, Mark Brian, M.D., Lic. No. J1898, Sherman  

On June 9, 2023, the Board and Mark Brian Buckner, M.D., entered into an Agreed Order of Voluntary Surrender in which Dr. Buckner agreed to voluntarily surrender his Texas medical license in lieu of further disciplinary proceedings. Dr. Buckner was under investigation for alleged impairment and for prescribing controlled substances to his office staff to divert for his own use.  

 

Haden, Marshall L., M.D., Lic. No. BP10078006, Houston  

On June 9, 2023, the Board and Marshall L. Haden, M.D., entered into an Agreed Order of Voluntary Surrender in which Dr. Haden agreed to voluntarily surrender his physician-in-training permit in lieu of further disciplinary proceedings. Dr. Haden was under investigation for allegations that he is unable to safely practice medicine due to his arrests in Texas and Illinois related to felony charges for Possession of Child Pornography. The Board terminated his permit effective March 1, 2023.  

 

Hyson, Morton Isaac, M.D., Lic. No. G4477, Las Vegas, NV  

On June 9, 2023, the Board and Morton Isaac Hyson, M.D., entered into an Agreed Order of Voluntary Revocation in which Dr. Hyson agreed to the voluntary revocation of his Texas medical license in lieu of further disciplinary proceedings. The Board found that the Nevada Board of Medical Examiners revoked Dr. Hyson’s license in September 2022, based on a boundary violation of a female patient when he touched her inappropriately and attempted to kiss her on the mouth. 

 

Rao, Sekhar Suryadevara, M.D., Lic. No. L1714, Austin On June 9, 2023, the Board and Sekhar Suryadevara Rao, M.D., entered into an Agreed Order of Voluntary Surrender in which Dr. Rao agreed to voluntarily surrender his Texas medical license in lieu of further disciplinary proceedings. The Board found Dr. Rao was convicted on two counts of health care fraud and is awaiting sentencing.  

 

Roth, Gregory Scott, M.D., Lic. No. K1916, San Antonio  

On June 9, 2023, the Board and Gregory Scott Roth, M.D., entered into an Agreed Order of Voluntary Surrender in which Dr. Roth agreed to voluntarily surrender his Texas medical license in lieu of further disciplinary proceedings. Dr. Roth is currently subject to an Order of Temporary Suspension following his arrest for possession or promotion of child pornography.  

 

 

REVOCATION  

Fechter, Cary, M.D., Lic. No. EVPTP, Houston  

On June 9, 2023, the Board entered a Default Order regarding Cary Fechter, M.D., which revoked his Emergency Visting Physician Temporary Permit. On February 7, 2023, the Board filed a Complaint with the State Office of Administrative Hearings (SOAH), alleging unprofessional conduct. Dr. Fechter failed to appear at the SOAH hearing and no responsive pleading was ever filed by Dr. Fechter. The Board granted a Determination of Default and Dr. Fechter’s permit was revoked by Default Order. The order resolves a formal complaint filed at SOAH. Dr. Fechter has 25 days from the service of the order to file a motion for rehearing.  

 

Netter, Tara, M.D., Lic. No. P8166, San Antonio  

On June 9, 2023, the Board entered a Final Order regarding Tara Netter, M.D., revoking her Texas medical license. On March 31, 2021, the Board filed a Complaint with the State Office of Administrative Hearings (SOAH), alleging unprofessional conduct. Dr. Netter failed to appear at the SOAH hearing and no responsive pleading was ever filed by Dr. Netter. The administrative law judge at SOAH granted the Board’s Motion for Summary Disposition. The order resolves a formal complaint filed at SOAH. Dr. Netter has 25 days from the service of the order to file a motion for rehearing.  

 

Winingham, Donna Elaine, M.D., Lic. No. F7317, Templeton, CA  

On June 9, 2023, the Board entered a Final Order regarding Donna Elaine Winingham, M.D., revoking her Texas medical license. The Board found Dr. Winingham’s license was revoked in California due to her failure to comply with the terms of her probation. The action was based on the findings of an administrative law judge at the State Office of Administrative Hearings (SOAH). The order resolves a formal filing at SOAH. Dr. Winingham has 25 days from the service of the order to file a motion for rehearing.  

 

 

NONTHERAPEUTIC PRESCRIBING  

Alexander, Joe Bob, M.D., Lic. No. E0780, Abilene  

On June 9, 2023, the Board and Joe Bob Alexander, M.D., entered into an Agreed Order requiring him to have his practice monitored by another physician for 12 consecutive monitoring cycles; within one year complete the prescribing course offered by the University of California San Diego Physician Assessment and Clinical Education (PACE) program; within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least eight hours of CME in medical recordkeeping; and within 60 days pay an administrative penalty of $5,000. The Board found Dr. Alexander nontherapeutically prescribed phentermine to patients with drug addictions rather than as part of a weightloss specialty clinic, failed the keep adequate medical records for several patients and did not regularly utilize urine drug screens to determine abuse or potential addiction by the patients.  

 

King, Winifred, M.D., Lic. No. M5295, Houston  

On June 9, 2023, the Board and Winifred King, M.D., entered into an Agreed Order prohibiting her from possessing, administering, or prescribing opioids, narcotics or Soma in Texas; shall not use her Texas license in any jurisdiction to diagnose, treat, or prescribe controlled substances to patients in Texas for chronic or post-surgical, post-procedure, persistent non-chronic pain as defined by Board rules or engage in the practice of pain management in Texas; within 30 days refer all current pain management patients to appropriate specialists; within seven days request modification of her DEA controlled substances registration certificate to eliminate Schedule II and not reregister without prior authorization; have her practice monitored by another physician for 12 consecutive monitoring cycles; within one year complete the prescribing course offered by the University of California San Diego Physician Assessment and Clinical Education (PACE) program; within one year and three attempts pass both the Special Purpose and Medical Jurisprudence Exams; within one year complete at least 24 hours of CME, divided as follows: eight hours in supervision, eight hours in medical recordkeeping and eight hours in ethics; within 60 days pay an administrative penalty of $3,000 and shall not supervise or delegate prescriptive authority to a physician assistant or advanced practice nurse or supervise a surgical assistant. The Board found Dr. King failed to meet the standard of care and inappropriately prescribed controlled substances for 20 patients, failed to monitor the patients, failed to keep adequate medical records, and inappropriately delegated prescribing authority to midlevel practitioners.  

 

Korivi, Naveendra, D.O., Lic. No. L1360, Houston  

On June 9, 2023, the Board and Naveendra Korivi, D.O., entered into an Agreed Order prohibiting him from using his Texas license in any jurisdiction to diagnose, treat, or prescribe controlled substances to patients in Texas for chronic or post-surgical, post-procedure, persistent non-chronic pain as defined by Board rules or engaging in the practice of pain management; within 30 days refer all current pain management patients to appropriate specialists; have his practice monitored by another physician for 12 monitoring cycles; within one year complete the prescribing course offered by the University of California San Diego Physician Assessment and Clinical Education (PACE) program; within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least 24 hours of CME, divided as follows: eight hours in medical recordkeeping; eight hours in prescribing controlled substances and eight hours in ethics; within 60 days pay an administrative penalty of $3,000 and shall not supervise or delegate prescriptive authority to a physician assistant or advanced practice nurse or supervise a surgical assistant. The Board found Dr. Korivi nontherapeutically prescribed controlled substances to 16 patients, failed to maintain adequate medical records, failed to follow Board rules in the treatment of chronic pain, and operated a clinic that should have been registered as a pain management clinic.  

 

 

IMPROPER SUPERVISION OR DELEGATION  

Baluch, Amir, M.D., Lic. No. N5550, Canton  

On June 9, 2023, the Board and Amir Baluch, M.D., entered into an Agreed Order requiring him to within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least 28 hours of CME, divided as follows: 12 hours in supervision/delegation, eight hours in risk management and eight hours in ethics; and within 60 days pay an administrative penalty of $2,500. The Board found Dr. Baluch failed to adequately delegate and/or supervise for the treatment of two patients who suffered complications following procedures provided at a med spa where he served as supervising medical director.  

 

MacKay, Daniel A., M.D., Lic. No. J7562, Dallas  

On June 9, 2023, the Board and Daniel A. MacKay, M.D., entered into a Mediated Agreed Order publicly reprimanding Dr. MacKay; requiring him to within one year complete the prescribing course offered by the University of California San Diego Physician Assessment and Clinical Education (PACE) program; within one year and three attempts pass the Medical Jurisprudence Exam; within one year complete at least 20 hours of CME, divided as follows: 12 hours in supervision and delegation, four hours in medical recordkeeping and four hours in risk management; and within 60 days pay an administrative penalty of $3,000. The Board found that for two midlevel providers, Dr. MacKay failed to adequately supervise the care and treatment provided to three patients who were receiving controlled substances under his prescriptive authority. The order resolves a formal complaint filed at the State Office of Administrative Hearings.  

 

 

VIOLATION OF BOARD RULES 

Tyler, David Lendon, M.D., Lic. No. E6664, Duncanville  

On June 9, 2023, the Board and David Lendon Tyler, M.D., entered into an Agreed Order requiring him to within one year complete at least 12 hours of CME, divided as follows: four hours in medical recordkeeping, four hours in risk management and four hours in appropriate prescribing of controlled substances; and within one year and three attempts pass the Medical Jurisprudence Exam. The Board found Dr. Tyler failed to keep adequate medical records for prescribing for one patient, did not access the Prescription Monitoring Program prior to prescribing the controlled substances and did not regularly conduct urine drug screening for the patient.  

 

 

OTHER STATES’ ACTIONS  

Bray, Timothy, D.O., Lic. No. H9496, Rio Rancho, NM  

On June 9, 2023, the Board and Timothy Bray, D.O., entered into a Waiver Order requiring him to comply with all terms of the agreement entered on or around February 14, 2023 with the New Mexico Medical Board. The Board found Dr. Bray had a disciplinary action entered with the New Mexico Medical Board based on false billing allegations. 

 

Konchada, Ravishankar, M.D., Lic. No. N8942, Las Vegas, NV  

On June 9, 2023, the Board and Ravishankar Konchada, M.D., entered into a Waiver Order publicly reprimanding Dr. Konchada; requiring him to comply with all terms of the agreement entered on or around March 3, 2023 in Nevada and within 90 days pay an administrative penalty of $1,500. The Board found Dr. Konchada was disciplined by the Nevada State Board of Medical Examiners based on him failing to seek consultation with another provider of health care in doubtful or difficult cases whenever it appears that consultation may enhance the quality of medical services.  

 

Liou, Wayne, M.D., Lic. No. TM00062, Eden Prairie, MN

n June 9, 2023, the Board and Wayne Liou, M.D., entered into a Waiver Order publicly reprimanding Dr. Liou; requiring him to comply with all terms of the agreement entered on or around March 15, 2023 with the Wisconsin Medical Examining Board; and within 90 days pay an administrative penalty of $780. The Board found Dr. Liou had a Final Decision and Order entered by the Wisconsin Board based on a failure to report a CT showing narrowing of the spinal canal and/or compression of the cord and existence of fluid collection around the facet.  

 

Manning, James Bentley, M.D., Lic. No. R9393, Las Vegas, NV  

On June 9, 2023, the Board and James Bentley Manning, M.D., entered into a Waiver Order publicly reprimanding Dr. Manning; requiring him to comply with all terms of the agreement entered on or around February 1, 2023 with the Nevada Board of Medical Examiners; and within 90 days pay an administrative penalty of $3,500. The Board found Dr. Manning entered into a Settlement Agreement with the Nevada Board based on violations NRS 630.30621(1)(a) and failure to maintain proper medical records.  

 

Momii, George, M.D., Lic. No. H7793, Las Vegas, NV On June 9, 2023, the Board and George Momii, M.D., entered into a Waiver Order requiring him to comply with all terms of the agreement entered on or around December 2, 2022 with the Nevada State Board of Medical Examiners; and within 90 days pay an administrative penalty of $3,500. The Board found Dr. Momii entered into a Settlement Agreement with the Nevada Board based on medical malpractice.  

 

Nguyen, Trung, D.O., Lic. No. L5847, Tyler  

On June 9, 2023, the Board and Trung Nguyen, D.O., entered into a Waiver Order requiring him to comply with all terms of the agreement entered on or around March 8, 2023 in Kentucky. The Board found Dr. Nguyen entered into an Agreed Order with the Commonwealth of Kentucky Board of Medical Licensure based on standard of care violations for improper prescribing.  

 

Qureshi, Amir, M.D., Lic. No. R5188, Plano  

On June 9, 2023, the Board and Amir Qureshi, M.D., entered into a Waiver Order publicly reprimanding Dr. Qureshi; requiring him to comply with all terms of the agreement entered on or around December 7, 2022 with the Arkansas State Medical Board; and within 90 days pay an administrative penalty of $500. The Board found Dr. Qureshi had an order entered by the Arkansas Board based on providing medical services that were grossly negligent.  

 

Sunga, Marcos, Jr., M.D., Lic. No. R0143, Rosiclare, IL  

On June 9, 2023, the Board and Marcos Sunga, Jr., M.D., entered into a Waiver Order publicly reprimanding Dr. Sunga; requiring him to comply with all terms of the agreement entered on or around December 30, 2022 and within 90 days pay an administrative penalty of $2,500. The Board found Dr. Sunga had a disciplinary action entered by the Illinois Medical Board based on Dr. Sunga improperly prescribing controlled substances to patients.  

 

Travis, Joe, M.D., Lic. No. L3506, Alexandria, LA  

On June 9, 2023, the Board and Joe Travis, M.D., entered into a Waiver Order prohibiting him from diagnosing, treating, or prescribing for patients in Texas or using his Texas license to practice medicine in any jurisdiction until he requests in writing and appears before the Board to provide evidence that indicates he is physically, mentally, and otherwise competent to safely practice medicine. The Board found Dr. Travis had his license in Louisiana placed on probation based on an inability to practice medicine with reasonable skill and safety. 

 

Trinidad, Elizabeth, M.D., Lic. No. L6684, Jupiter, FL  

On June 9, 2023, the Board and Elizabeth Trinidad, M.D., entered into a Waiver Order requiring her to comply with all terms of the agreement entered on or around August 30, 2022 with the Florida Department of Health and within 90 days pay an administrative penalty of $3,000. The Board found Dr. Trinidad had a disciplinary action entered in Florida based on Dr. Trinidad changing a procedure without providing adequate medical justification in the patient’s medical records.  

 

 

INADEQUATE MEDICAL RECORDS  

Kaufman, James Kevin, M.D., Lic. No. L0318, Hurst 

On June 9, 2023, the Board and James Kevin Kaufman, M.D., entered into an Agreed Order requiring him to within one year complete the medical recordkeeping course offered by the University of California San Diego Physician Assessment and Clinical Education (PACE) program; and within one year complete at least eight hours of CME, divided as follows: four hours in risk management and four hours in medical recordkeeping. The Board found Dr. Kaufman did not adequately document his attempts to address the patient’s follow-up care for a patient that was transferred to a facility where Dr. Kaufman did not have privileges following an administrative delay at the facility where he wanted to treat the patient. Post-operatively the patient experienced neurological outcomes which could be attributed to the delay in transfer. Dr. Kaufman’s medical record for surgical treatment and delay with the transport issue could have been more robust.  

 

Morris, Randall Emmett, M.D., Lic. No. G8303, Houston  

On June 9, 2023, the Board and Randall Emmett Morris, M.D., entered into an Agreed Order requiring him within one year complete the medical recordkeeping course offered by the University of California San Diego Physician Assessment and Clinical Education (PACE) program. The Board found Dr. Morris did not adequately document the medical care provided to a patient.  

 

 

CEASE & DESISTS  

Guajardo, Tracey, No License, Corpus Christi  

On June 9, 2023, the Board and Tracey Guajardo entered into an Agreed Cease and Desist Order prohibiting her from practicing medicine in the state of Texas without a license issued by the Texas Medical Board, to wit, performing medical procedures under the directorship of a physician, without having patients evaluated by said medical director; and advertising in a manner which could be misleading. The Board found Ms. Guajardo is the registered agent for Allure Aesthetix and based on information and belief, patients who visit Aesthetix are not evaluated by the medical director before receiving services.  

 

Hinkel, Phillip C., R.N., Litchfield Park, AZ  

On June 9, 2023, the Board and Phillip C. Hinkel, R.N., entered into an Agreed Cease and Desist Order prohibiting him from acting as, or holding himself out to be, a licensed physician in the state of Texas. The Board found Mr. Hinkel, who is a registered nurse in the state of Arizona, is the owner of a company that diagnoses and treats with IV fluids. Medical records show no physician approval was done prior to the IV fluid administration.
