Is a CRNA under a valid delegation order, subject to discipline by the Texas Medical Board under the Medical Practice Act for a violation of the standard of care in the selection and administration of anesthesia or the care of an anesthetized patient?
No, while the selection and administration of anesthesia is a medical act, if such an act was validly delegated to a CNRA by a physician, the act is considered to be within the practice of nursing and governed by the Nursing Practice Act. Any discipline for a violation of the standard of care by a CRNA would be carried out by the Texas Board of Nursing under the authority of the Nursing Practice Act. Ultimate responsibility and accountability for the medical management of a patient under anesthesia remains with the delegating physician who may be subject to discipline for improper delegation dependent upon the facts and circumstances of each case, and how state statutes and regulations apply in those situations.

Applicants are informed of their fingerprints being rejected by IdentoGo prior to that information being sent to the TMB. Fingerprints can be rejected by either DPS or the FBI. Our office will not communicate that a reprint is needed until we receive your unique reference code, which you may then use on the IdentoGo site to waive the fee for a required reprint.

Will I automatically be sent fingerprint cards if I enter an out-of-state address when I apply?
No, fingerprint cards are not automatically sent out to applicants. Because not all applicants reside at the mailing address of record when they submit their online applications, it is the responsibility of the applicant to verify whether or not they can be live-scanned. If that is not an option, they must request a fingerprint card by contacting the Texas Medical Board at Screen-CIC@tmb.state.tx.us if they are an applicant, or at Registrations@tmb.state.tx.us if they are a licensee. When emailing the request, please include a current mailing address.

A Board issued 6-digit ID number is required for submitting your fingerprints. This 6-digit ID number is assigned at the time of application submission. Are CRNA’s authorized to practice independent of physician supervision and delegation?
No, neither the Medical Practice Act nor the Nursing Practice Act authorize independent practice by a CRNA. Additionally, Texas Attorney General Opinion No. KP-0266 found “A certified registered nurse anesthetist does not possess independent authority to administer anesthesia without delegation by a physician.” (Page 5). Since the selection and administration of anesthesia is a medical act, CRNAs must be properly delegated this act by a physician. A CRNA who administers anesthesia without proper delegation from a physician would be liable for the unlicensed practice of medicine.

To return to practice from retired status, a physician must obtain approval of the Board after submitting a written request. Do I have to let the Medical Board know about my delegates/supervising physicians?
Yes, if you are a physician or a physician assistant.
Physicians are required to register all PAs and APRNs that they supervise prior to the delegates beginning to work for them. If there is a change to the scope of the delegation, physicians must notify the Board within 30 days of this change.
PAs are likewise required to register their supervising physicians with the Board prior to beginning to practice under the employment or prescriptive authority agreement. They are also required to notify the Board within 30 days of any change to the scope of the delegation.
APRNs should look to guidance provided by the Texas Board of Nursing for how to register their delegating physicians, as the Medical Board does not have licensing authority for nurses.

If you are granted a waiver, it will be displayed on your public physician profile. This alone will serve as proof of your waiver. Generally, waiver requests are determined within 2-3 business days. You are encouraged to check your profile daily upon submitting your waiver request. You may also choose to print a simple copy of the ‘Verified Information’ section of your profile, which includes your waiver status, by choosing the “Print Verification” option on your profile.

Yes, you can complete the fingerprint requirement at any point prior to your license expiration date. You do not need to wait for your expiration date. If you wish to submit your fingerprints early, please contact us at Registrations@tmb.state.tx.us and request your 6 digit ID number and instructions for your fingerprint submission.
*Please note that completing your fingerprints prior to your renewal period will NOT enable you to renew your license early. Your registration window will only open within 60-90 days of your license expiration date.
