“No. The old site-based prescriptive authority system is no longer in effect. ”
Do the requirements for types of practice sites still apply?
No. The old site-based prescriptive authority system is no longer in effect.
“... ay order or prescribe this equipment provided all requirements for delegation of prescriptive authority are met. ”
Is prescriptive authority required to order durable medical equipment (DME)?
Yes. SB 406 clarified that it is necessary to have prescriptive authority to order these devices. In the past, it was not clear to DME suppliers that APRNs and PAs had this authority. The changes to the law as a result of the passage of SB 406 clearly indicate that APRNs and PAs may order or prescribe this equipment provided all requirements for delegation of prescriptive authority are met.

What are the Texas Medical Board’s requirements for a physician who delegates to an APRN or PA?
All prescriptive delegation requires adequate supervision under the Medical Practice Act. As such, a physician delegating to an APRN or PA must adequately supervise those individuals. An individual physician may serve in both the supervising and delegating role and does not need to be physically present at all times to be considered to have adequate supervision.
“... egal counsel to better understand the law’s requirements. For prescriptive authority agreements entered on or after September 1, 2019, the law changed so that all prescriptive authority agreements must be conducted on at least a monthly basis, no matter the length of time that the physicians ha ... ”
How often are meetings required?
It depends upon when the agreement was executed. For prescriptive authority agreements entered into prior to September 1, 2019, factors such as the type of delegate licensure and amount of time spent practicing under an agreement determined the required frequency and manner of meetings. If your agreement was entered into prior to September 1, 2019, you may want to seek the advice of private legal counsel to better understand the law’s requirements.
For prescriptive authority agreements entered on or after September 1, 2019, the law changed so that all prescriptive authority agreements must be conducted on at least a monthly basis, no matter the length of time that the physicians have been practicing with the delegates under the agreement.
“... only level I services, must still meet all other requirements under Chapter 192. ”

What are the requirements for an international medical school graduate to get a Full Texas Medical License?
The requirements are the same for International Medical School Graduates (IMGs) and U.S. or Canadian medical school graduates except that:
“... ith this status has maintained their registration requirements while the license is suspended, and should that suspension be lifted, the license can return to an active status without additional registration requirements. ”
This physician’s profile shows “Registration Status: Suspended, Active”. How can a license be suspended and active at the same time?
The registration status “Suspended, Active” is a suspended status. A license in this status is not an active license to practice medicine in Texas. However, a licensee with this status has maintained their registration requirements while the license is suspended, and should that suspension be lifted, the license can return to an active status without additional registration requirements.
“... NCT page in our Licensure section for additional requirements and instructions. ”

“Meetings must at a minimum: involve discussion of patient care improvement; include the sharing of information relating to patient treatment and care, needed changes in patient care plans, and issues relating to referrals; and be documented. ”
Are there other requirements with respect to the meetings?
Meetings must at a minimum:
“... such other remedial or restrictive conditions or requirements which, in the discretion of the board, are necessary to ensure protection of the public and minimal competency of the applicant to safely practice medicine. ”
Are there any additional requirements that I need to complete before I request to return my retired physician license to an active status?
To return to practice from retired status, a physician must obtain approval of the Board after submitting a written request. Please contact the Registration department for information on the approval procedure.
If the request is granted, it may be granted without conditions or subject to such conditions which the board determines are necessary to adequately protect the public. Requests are reviewed on a case by case basis.
Below are some examples of conditions that may be required (alone or in combination) to return a retired license to an active status:
